Terms of Use

Welcome to CampMeUp. These Terms of Use ("Terms") govern your access to and use of the CampMeUp platform, including the mobile application and website (collectively, "Services"), operated by CampMeUp Ltd. ("Company", "we", "our", "us").

By creating an account or using our Services, you agree to be bound by these Terms. If you do not agree, do not use our Services. These Terms apply to all users, including guests, hosts, and visitors.

1. Eligibility

You must be at least 18 years old to use CampMeUp. By agreeing to these Terms, you represent and warrant that:

• You are at least 18 years of age;
• You have the legal capacity to enter into a binding agreement;
• You are not prohibited from using the Services under applicable law;
• All registration information you provide is accurate and current.

2. Account Registration

To access certain features, you must create an account. You agree to:

• Provide accurate, complete, and current information during registration;
• Maintain the security of your account credentials;
• Notify us immediately at support@campmeup.com of any unauthorized access;
• Be responsible for all activity that occurs under your account.

We reserve the right to suspend or terminate accounts that violate these Terms or provide false information.

3. Description of Services

CampMeUp is a marketplace platform that connects guests seeking outdoor accommodation with hosts offering campsites, caravans, glamping, cabins, private land, and related outdoor stays. CampMeUp acts as an intermediary and is not a party to agreements between guests and hosts. We do not own, operate, manage, or control any listings.

4. Guest Terms

As a guest using the platform:

• You may search, view, and book available listings through the app;
• Bookings are confirmed only after payment is successfully processed;
• You agree to comply with the house rules and check-in/check-out times set by the host;
• You are responsible for any damage to the property during your stay beyond normal wear and tear;
• You will treat the property, host, and other guests with respect;
• You will not use the property for any illegal activity;
• You acknowledge that CampMeUp is a marketplace and hosts are independent third parties.

5. Host Terms

As a host listing property or vehicles on CampMeUp:

• You represent that you have the legal right to list and rent out your property or vehicle;
• You must provide accurate descriptions, photos, pricing, and availability;
• You are solely responsible for compliance with all local laws, permits, zoning regulations, and taxes relating to your listing;
• You must honor confirmed bookings except in cases of extenuating circumstances (as defined in our Extenuating Circumstances Policy);
• You grant CampMeUp a non-exclusive license to display your listing content on the platform for the purpose of providing the Services;
• CampMeUp charges a service fee for each completed booking, as detailed in the app.

6. Payments and Fees

All payments are processed through Stripe, Inc. By making or receiving a payment, you agree to Stripe's terms of service. CampMeUp collects a service fee from guests and a host fee from hosts on each transaction. Fees are displayed clearly at checkout and before a booking is confirmed. CampMeUp reserves the right to modify fees with 30 days' prior notice.

7. Booking Cancellations

Cancellations are governed by the cancellation policy selected by the host (Flexible, Moderate, or Strict) and our Refund Policy. In all cases, guests may cancel within 24 hours of booking for a full refund, provided check-in is more than 7 days away. Please review the refund policy before booking.

8. Prohibited Conduct

You agree not to:

• Use the Services for any unlawful purpose or in violation of any laws;
• Post false, misleading, or fraudulent listings or reviews;
• Harass, abuse, or harm other users;
• Circumvent the platform to make off-platform bookings or payments;
• Scrape, crawl, or extract data from the platform without permission;
• Reverse engineer, decompile, or attempt to access the source code of the app;
• Use automated bots or scripts to interact with the platform;
• Interfere with the security or integrity of the Services.

9. Intellectual Property

All content, trademarks, logos, and software on the CampMeUp platform are owned by CampMeUp Ltd. or its licensors. You may not reproduce, distribute, or create derivative works without our prior written consent. User-generated content (reviews, photos, listings) remains your property; by submitting it, you grant CampMeUp a worldwide, royalty-free license to display it within the Services.

10. Limitation of Liability

To the maximum extent permitted by applicable law, CampMeUp and its officers, employees, agents, and licensors shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, goodwill, or property damage arising from your use of the Services or any listing. Our total liability for direct damages shall not exceed the amount paid by you to CampMeUp in the three (3) months preceding the claim.

11. Disclaimer of Warranties

The Services are provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to merchantability, fitness for a particular purpose, or non-infringement. CampMeUp does not warrant that the Services will be uninterrupted, error-free, or free of viruses or other harmful components.

12. Indemnification

You agree to indemnify and hold harmless CampMeUp, its affiliates, officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including legal fees) arising from your use of the Services, your violation of these Terms, or your violation of any rights of another person.

13. Governing Law and Dispute Resolution

These Terms are governed by the laws of [Jurisdiction Placeholder], without regard to conflict of law principles. Any disputes shall first be attempted to be resolved informally by contacting legal@campmeup.com. If unresolved, disputes shall be submitted to binding arbitration or, where applicable, to the competent courts of [Jurisdiction Placeholder].

14. Changes to Terms

We may modify these Terms at any time. We will provide at least 14 days' notice via email or in-app notification before changes take effect. Your continued use of the Services after that date constitutes acceptance of the updated Terms.

15. Termination

We may terminate or suspend your account at any time for violation of these Terms, fraudulent activity, or for any reason with 7 days' notice. You may delete your account at any time through the app settings or by contacting support@campmeup.com.
